Terms of Use · MoqiKey

These Terms of Use (“terms”) are the agreement between you and Taco Hsiung about using MoqiKey. By using MoqiKey you agree to these terms and to the Privacy Policy. If you do not agree, please do not use it. This is an English translation; if it differs from the Traditional Chinese version, the Traditional Chinese version applies.

1. Who we are

MoqiKey (the Android app, the keyboard, MOQI AI and its server, and the website moqikey.com) is developed and run by Taco Hsiung.
“We” in these terms means Taco Hsiung; “you” means a person using MoqiKey.

2. Age

You must be 18 or older to use MoqiKey. When you sign in with Google, you confirm that you are 18 or older.
If we learn that someone under 18 is using it, we delete that account.

3. What MoqiKey is

MoqiKey is a keyboard (input method) for Android. Typing, word suggestions, handwriting and the clipboard work on your phone.
MOQI AI (the MOQI assistant, Auto-translate copied messages, MOQI AI voice typing, My style summaries and so on) needs an internet connection; our server passes requests to an AI service. What is sent and how to turn it off is in section 4 of the Privacy Policy.
MoqiKey is in testing. Features may be added, changed or removed, and test versions may have bugs or be unavailable for a while.
MoqiKey is available for Android only.

4. AI answers

AI translations, tone readings and suggestions can be wrong, incomplete or wrong for your situation, and can misread tone or culture. Check every message before you send it. What you send, and to whom, is your decision and your responsibility.
MOQI’s reading of a message is a suggestion, not what the other person actually thinks.
AI answers are not legal, medical, financial, psychological or other professional advice. For important decisions, talk to a professional.
If you see an inappropriate answer, tap “Report this reply” in the keyboard to tell us.

5. Your account

MOQI AI may require a Google sign-in. Keep your Google Account and your phone secure; you are responsible for what is done with your account.
An account is for one person. Do not transfer, sell or share it.
You can delete your account at any time on the app’s Account page, or request deletion at https://moqikey.com/account/delete. What is deleted and what is kept is in section 14 of the Privacy Policy.

6. Acceptable use

Do not use MoqiKey to:

harass, threaten, bully or stalk anyone, or write hateful or discriminatory content;
scam, phish, impersonate a person or organization, or send spam;
manipulate or coerce people, for example emotional blackmail or pressuring someone for money or private photos;
put other people’s sensitive data (such as ID numbers, health information, private photos or passwords) into profiles or send it to MOQI AI beyond what the conversation really needs;
process data about minors beyond what is necessary. If the other person is under 18 (for example a family member), write only what is needed; any sexual content involving minors is forbidden;
produce sexually explicit content, or infringe other people’s copyright, privacy or other rights;
do anything that breaks the law where you are;
get around daily limits, regional restrictions or other safeguards, take apart or modify the app to misuse MOQI AI, call our server automatically in bulk, or attack or disrupt our service.

If you break these rules, we may refuse requests, or limit or stop your account’s or device’s use of MOQI AI. Where the law requires it, we cooperate with the authorities.

7. Your content

What you type, what you send to MOQI AI and the suggestions MOQI gives you are yours. We claim no rights in them.
To provide the service, you allow us to pass the content you choose to send to an AI service and return the result to your phone. Our server does not keep this content; how it is processed is in section 5 of the Privacy Policy.
What you send us yourself (for example messages in Help & feedback, or “Report this reply”) is used to answer you and deal with what you reported, and is deleted on the schedule in the Privacy Policy.
You must have the right to share the content you send, including messages other people sent you.

8. Limits and changes to the service

MOQI AI has a daily limit, counted per device and per account, which resets the next day; an account’s limit may depend on its plan (the free plan or MoqiKey Plus). There is also an overall daily limit; when it is reached, MOQI AI pauses until the next day. Limits may change; the app’s Usage page shows how much you have used today.
We may add, change or stop features, and may change the AI service we use; we update the Privacy Policy before changing it.
The service may be interrupted for maintenance, security or legal reasons.

9. Paid plans

If we offer a paid plan (such as MoqiKey Plus), it is sold as a Google Play subscription and can be bought only in the version installed from Google Play. The price, billing period and renewal terms are those Google Play shows when you buy.
Payment is handled by Google Play under Google Play’s terms; we never see your card or payment details.
Subscriptions renew automatically until you cancel. Cancel under “Payments & subscriptions” in Google Play; after cancelling, you keep access until the end of the period you paid for.
Deleting your MoqiKey account does not cancel your Google Play subscription or refund it. Cancel the subscription first, then delete the account. Deleting the account also ends its Plus, including days from redeem codes and support compensation.
Refunds follow Google Play’s refund policies and the law that applies to you.
Redeem codes are only given away free. They cannot be bought, sold or resold, and each has a redeem-by date and a limit on uses.
If prices change, you will be told in advance as Google Play’s rules require.

10. Stopping and termination

You can stop using MoqiKey at any time: uninstall the app, or delete your account.
If you break these terms or the law, we may suspend or end your use of MOQI AI or your account. Where we can, we will tell you why first.
If we decide to stop offering MoqiKey or MOQI AI, we will give as much notice as we reasonably can in the app or on the website. Paid subscriptions are handled under Google Play’s rules and the law that applies.
Sections 7, 11, 12 and 15 continue to apply after termination.

11. Disclaimer

To the extent the law allows, MoqiKey is provided as it is. We work to make it useful, accurate and reliable, but we do not promise it will never fail or be interrupted, or that AI answers will be correct or right for you.
The apps you type into with MoqiKey, and third-party services such as Google’s, are their providers’ responsibility.
Nothing in this section affects rights you have under consumer protection or other laws that cannot be excluded.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, such as personal, work or financial consequences of sending a message MOQI suggested, or loss of data or profits.
To the extent the law allows, our total liability to you is limited to the amount you paid us for MoqiKey in the 12 months before the event.
These limits do not apply to damage caused by our intent or gross negligence, or to liability that cannot be limited by law.

13. Intellectual property

The MoqiKey app, code, name, logo, the MOQI character and the website’s content belong to Taco Hsiung or to those who licensed them to us.
We give you a personal, non-transferable licence to use MoqiKey on your own Android devices.
Except where the law allows it, do not copy, modify, take apart or resell MoqiKey.
Open-source software and data used in the app are under their own licences, listed in the app under About & licenses.

14. Changes to these terms

We may update these terms. We will tell you about important changes in the app or on the website before they take effect.
If you keep using MoqiKey after a change takes effect, you accept the new terms. If you do not agree, stop using it and delete your account.

15. Governing law and courts

These terms are governed by the laws of the Republic of China (Taiwan).
For disputes about these terms or MoqiKey, both sides agree that the Taiwan Taipei District Court is the court of first instance.
If the law where you live gives consumers more protection, that protection is not affected.

16. Other terms

If any part of these terms is invalid, the rest still applies.
If we do not enforce a right straight away, we have not given it up.
This English version is a translation; if it differs from the Traditional Chinese version, the Traditional Chinese version applies.
